Terms And Conditions
Throughout this Service Contract, the words “We,” “Us”, and “Our” refer to AIG Warranty Services and Insurance Agency, Inc. (“AIGWS”) in those states that AIGWS is the Provider (“Obligor”), and the Dealer in those states where the Dealer is the Obligor of this Extended Service Contract (“ESC”). The words “You” and “Your” refer to the Contract Holder or the person to whom it was properly transferred.
Term and Coverage: The term of this ESC commences at date of purchase of the eligible covered product(s) and is inclusive of the manufacturer’s warranty. This ESC does not replace the manufacturer’s warranty, but provides certain additional benefits during the term of the manufacturer’s warranty. After the manufacturer’s warranty expires this ESC continues to provide some of the manufacturer’s benefits as well as certain additional benefits listed within this ESC.
Repair Plan1. What Is Covered: We will restore a covered product to normal operating condition after it has failed during normal use due to mechanical and or electrical breakdown, which leads to the failure of Your covered product to perform its intended functions. This ESC covers labor and parts costs necessary to repair Your covered product with no deductible. If We determine Your covered product cannot be repaired, We will replace it with a product of like kind and quality. Technological advances may result in a replacement product with a lower selling price than the original product. The following products are covered:
A. Major Appliances: Included but not limited to, dishwashers, dryers, freezers, garbage disposals, microwave ovens, ovens, range hoods, exhaust systems, ranges, counter cook tops, refrigerators, room air conditioners, trash compactors, and washers are covered. All functional internal factory installed parts such as bearings, clocks and timers, compressors, hinges, electrical wiring, heating elements, internal hoses, motors, safety switches, sealed systems, seals and gaskets, switches, thermostats, and valves.
B. Consumer Products: Included but not limited to, camcorders, cameras, DSS, small appliances, digital video disk players and recorders, projection televisions, stereos, car audio, mobile video, telephones, small electronics, televisions, floor cleaners, sewing machines, fitness equipment and vacuum cleaners. All functional internal factory installed parts such as capacitors, circuit boards, controls, fans, fuses, heat sinks, IC chips, motors, picture tubes, processors, projection television fluids, resistors, switches, timers, transformers, transistors, and tuners. All functional original manufacturers supplied external parts and accessories such as: battery chargers (excluding batteries), power adapters, supplies, and internal antennas (excluding cables).
C. Lawn & Garden: Included but not limited to mowers, power tools, blowers, riding mowers, generators, snow blowers, pressure washers and edgers.
2. Additional Coverages & Services
A. On-Site Service: On-Site service will be provided for all major appliances, televisions, TV/VCR combos, satellite systems, and home theatre equipment All other >product categories are covered for carry-in, depot or replacement service. On-Site Service will be provided when Your residence is located within thirty (30) miles of an authorized service provider. You will be responsible for excess mileage charges when your product is located more than thirty (30) miles from an authorized service center. Due to environmental and technical requirements, if certain repairs cannot be completed at Your residence and must be completed at an authorized service center and We need to ship Your product to complete repairs, We will pay for shipping and handling costs.
B. Food Spoilage: We will reimburse You for food loss that results from a covered mechanical or electrical component failure. Our limit of liability for this coverage is two hundred dollars ($200.00) per occurrence within any twelve-month period. We reserve the right to request purchase receipts and or list of spoiled contents when making a claim.
C. Power Surge Protection: This Service Contract provides power surge protection in excess of any other insurance coverage, from the date of purchase of this ESC.
D. No Lemon Guarantee: Following the expiration of the manufacturer’s warranty term and after two service repairs have been completed, for the same problem, on an individual product, and that product requires a third repair, as determined by Us, We reserve the right to replace the product with a product of, like kind and quality, not to exceed the original retail purchase price excluding taxes. Once the product is replaced, this ESC is considered fulfilled. The original product may be requested to be returned to Us. Preventative maintenance checks, cleanings, product diagnosis, customer education, accessory repairs or replacements are not considered repairs for the purposes of the No Lemon Clause.
E. Remote Control Coverage: If Your remote control should fail, We will replace the remote with one of like kind and similar quality, not limited to a generic brand. >
F. Commercial Coverage: Is not available on any product.
3. Service Contract Limits of Liability: Aggregate Limit: The total payment(s) for all claims under this ESC shall not exceed the original retail purchase price of the covered product or system excluding taxes.
4. Non-Repairable Products – If We determine that the product is not repairable, We may replace the product with a product of, like kind and quality, not to exceed the original retail price excluding taxes. Once the product is replaced, this ESC is considered fulfilled. Replacement parts will be new, rebuilt or non-original manufacturer’s parts that perform to the factory specifications of the product. We may request that the original product be returned to us.
5. Service Contract Holder’s Responsibilities: You must follow the instructions for use provided in the owner’s manual of Your product. You must have Your product maintained in accordance with the manufacturer’s recommendations, as outlined in the owner’s manual. Failure to follow the manufacturer’s maintenance and service recommendations may result in the denial of Coverage under this ESC.
6. If You Need Service: You may begin the claim process by calling 1-877-FIXESIT (349-3748). Repair service will be available during regular business hours, Monday through Friday, Eastern Standard Time and will be provided by an authorized service center, or the Dealer named on this contract. After We authorize Your claim, You may arrange for service and We will cover the reasonable parts and labor costs that We authorize. You may be asked to provide proof of purchase as a condition for receiving service under this ESC. Your original purchase receipt should be kept with this ESC in a safe place. This ESC is secured by a contractual liability insurance policy provided by New Hampshire Insurance Company, 175 Water St., 20th Floor, New York, NY 10038 and Phone Number (800) 250-3819.If You fail to receive a cancellation refund, claim payment, service or a replacement product within sixty (60) days of submitting the request, You may submit the claim directly to the insurance company.
A. You must provide a safe, non-threatening environment for our technicians in order to receive service.
7. Exclusions & What Is Not Covered - Your ESC Does Not Cover:
A. All new and refurbished products with less than an original thirty (30) days manufacturer’s parts and labor limited warranty.
B. Consumer replaceable items such as batteries, including rechargeable batteries; tapes; ribbons; bulbs including projection television and LCD projector bulbs; data storage media; filters; ink, toner cartridges and drums; fuses; blades; replaceable fluids; or any other parts or materials which are designed to be consumed during the life of the product. Loss of or damage to data, recording media, and software. All software and data must be backed up by You prior to commencement of repair.
C. Failures of the following non-operational components such as but not limited to: cabinetry and cabinet frames, decorative finishing, door liners, glass, including projection television exterior screens, handles, knobs, masks, racks, rollers, shelves, and cosmetic damage.
D. Television or personal computer monitor screen imperfections, including ‘burn-in’ or burned CRT phosphor, caused by video games, prolonged display of one or more signal(s), or other abuse.
E. Damaged or defective LCD screens when the failure is caused by abuse.
F. Damage resulting from unauthorized repair; software virus; improper gas or water connections, or electrical wiring and connections; damage caused during delivery, improper installation, or setup; user facilitated minor adjustments and settings outlined in the product’s owners manual; external antenna or local reception problems; inaccessible products or parts; negligence, misuse or abuse.
G. Failures due to corrosion, rust, dust, animal or insect damage; Acts of God such as fire, water, windstorm, sand, dirt, hail or earthquake; civil disorders; riot; nuclear accident; accidental physical damage by any external cause; malicious mischief; theft or vandalism.
H. Your failure to follow the instructions described in the product’s owner’s manual, manufacturer’s recommended maintenance procedures, requirements and misuse or abuse of the product; damage caused by leaking batteries.
I. Any service request, which results in customer education or no problem found diagnosis.
J. Failure, inoperability, or disruption of any product or product functions due to any manufacturer defect.
K. Components and products used for commercial purposes. Products provided for public use or rental.
L. Conditions, which existed prior to Your purchase and delivery of the product or the ESC. Special, indirect, incremental, or consequential damages; loss of use.
M. You will be responsible for excess mileage charges if any when Your covered product is located more than thirty (30) miles from the nearest authorized service provider.
N. Any cost associated with tearing apart walls, cabinetry, etc. to access wiring, components, etc. associated with Home Theater Equipment.
O. We are not responsible for personal items left in the product to be repaired.
P. This Service Contract excludes products that are not listed on the Service Contract.
Q. The Service Contract is fulfilled when a product is replaced after the expiration of the manufacturer’s warranty.
R. Theft
8. Renewal: A renewal of this ESC maybe available to you at expiration. The renewal ESC price will reflect the age, condition of the product, and current service prices. For more information, call 1-877-FIXESIT (349-3748).
9. Transfer: This ESC may be transferred to an eligible party to whom You sell or give the equipment while this ESC is in force. For more information, call 1-877-FIXESIT (349-3748) or send your request in writing within 15 days of transfer of ownership to the administrator’s address cited below.
10. Cancellation: You, the Purchaser, may cancel this ESC, at any time, by submitting Your request in writing to Us. The refund amount of the ESC paid will be 100% if the cancellation occurs within 30 days of the date of purchase, and We have not paid a claim. After 30 days, the balance of the ESC price will be refunded in the amount of the customary short rate based upon the expired term of the ESC, less any claims that have been paid, less a cancellation fee of $25.00 or 10% of the purchase price, whichever is less. Neither the Dealer nor We may cancel this contract except in the event of the Purchaser’s or Your fraud, material misrepresentation or failure to pay the price of the ESC.
11. Service Contract Provider (Obligor) & State Variations: AIGWS is the obligor and provider under this plan, except in California, Oklahoma and Wisconsin. AIGWS can be contacted at: 500 West Madison Street, Chicago, IL 60661. Telephone number (800) 250-3819. The Dealer is considered the Obligor only in those States which require the Dealer to be the obligor. Warranty Corporation of America (WaCA) is the administrator of this plan.
If You reside in one of the following states, these provisions apply to You:
Alaska: The Dealer is the Obligor under this ESC.
Arizona: If Your written notice of cancellation is received prior to the expiration date, the Administrator shall refund the remaining pro-rata price, regardless of prior services rendered under the ESC.
California: AIG Warranty Guard, Inc. (AIGWG) is the Obligor under this ESC. AIG Warranty Guard, Inc. (AIGWG) and AIG Warranty Services and Insurance Agency, Inc. (AIGWS) can be contacted at 500 Madison St., Chicago, IL 60661.
Connecticut: The expiration date of this ESC shall automatically be extended by the duration that the product is in our custody while being repaired. In the event of a dispute with the Administrator, you may contact The State of Connecticut, Insurance Department, PO Box 816, Hartford, CT 06142-0816, Attn: Consumer Affairs. The written complaint must contain a description of the dispute, the purchase price of the product, the cost of repair of the product and a copy of the ESC.
Georgia: Cancellation will comply with Section 33-24-44 of the Georgia code.
Kansas: This ESC is not an insurance policy.
Nevada: If you cancel this ESC, no deduction shall be made from the refund for the cost of any service received.
North Carolina: The purchase of this ESC is not required either to purchase or to obtain financing for a home appliance.
Oklahoma: The Dealer is the Obligor under this ESC. This Contract is not issued by the manufacturer or wholesale company marketing the product covered by this ESC. This ESC will not be honored by such manufacturer or wholesale company. If either You or we cancel this ESC, the return of the ESC price will be based upon one hundred (100) percent of the unearned pro rata price of the ESC, less the cost of any service received.
South Carolina: To prevent any further damage, refer to the owner’s manual. In the event the ESC provider does not provide covered service within sixty (60) days of proof of loss by the contract holder, the contract holder is entitled to apply directly to the New Hampshire Insurance Company. If the insurance company does not resolve such matters within sixty (60) days of proof of loss, they may contact the South Carolina Department of Insurance at PO Box 100105, Columbia, South Carolina 29202, telephone number (800) 768-3467.
Utah: Coverage afforded under this Contract is not guaranteed by the Utah Property and Casualty Guarantee Association.
Wisconsin: This Service Contract is subject to limited regulation by the Wisconsin Office of the Commissioner of Insurance. This ESC shall not be cancelled due to unauthorized repair of the covered equipment. If you cancel this ESC, no deduction shall be made from the refund for the cost of any service received. This ESC is backed by a contractual liability policy with limits of liability of $5000 per claim and $25,000 in aggregate per plan. Warranty Corporation of America is the Obligor under this ESC.
